Welcome to Behavior Genie (“Behavior Genie,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of the website, mobile applications, and related services available through https://behaviorgenie.com (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Services.

1. Eligibility

You must be at least 18 years old to create an account. Children may use certain portions of the Services, including Kid Mode, under adult supervision and with parental or guardian consent.

By using the Services, you represent and warrant that:

  • You are legally capable of entering into a binding agreement
  • You are using the Services on behalf of yourself or an authorized organization
  • Any information you provide is accurate and current
  • You will comply with these Terms and applicable laws

2. Description of Services

Behavior Genie provides tools designed to support behavior tracking, routines, visual supports, schedules, token boards, timers, reinforcement systems, and AI-assisted insights for parents, caregivers, educators, and professionals.

Features may include:

  • Behavior tracking and journaling
  • Visual schedules
  • First/Then boards
  • Token boards and reward systems
  • Choice boards
  • Visual timers
  • AI-assisted suggestions and summaries
  • Templates and image libraries
  • Communication and organizational tools

We may modify, improve, suspend, or discontinue portions of the Services at any time.

3. No Medical or Clinical Advice

Behavior Genie is an educational and organizational support platform.

The Services do not provide:

  • Medical advice
  • Mental health treatment
  • Psychological services
  • ABA therapy services
  • Clinical diagnosis
  • Emergency services
  • Legal advice

AI-generated insights, recommendations, summaries, and suggestions are informational only and should not be relied upon as a substitute for professional judgment or licensed professional services.

Always consult qualified professionals regarding medical, behavioral, psychological, educational, or therapeutic decisions.

If you are experiencing an emergency or crisis, contact emergency services or a qualified professional immediately.

4. User Accounts

You may be required to create an account to access certain features.

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activity occurring under your account
  • Providing accurate account information
  • Promptly updating account information when needed

You agree not to:

  • Share accounts improperly
  • Allow unauthorized access
  • Use another person’s account without permission
  • Attempt to circumvent security measures

We reserve the right to suspend or terminate accounts that violate these Terms.

5. User Content

You may submit, upload, create, or store content through the Services (“User Content”), including:

  • Behavior logs
  • Notes and observations
  • Uploaded images
  • Schedules and routines
  • Reward systems
  • Communications
  • Custom templates

You retain ownership of your User Content.

By submitting User Content, you grant Behavior Genie a non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, and display the content solely for the purpose of operating, improving, and providing the Services.

You represent and warrant that:

  • You have the necessary rights to submit the content
  • Your content does not violate any laws or third-party rights
  • Your content is not unlawful, abusive, infringing, or harmful

We reserve the right to remove content that violates these Terms.

6. Acceptable Use

You agree not to:

  • Use the Services for unlawful purposes
  • Upload harmful, abusive, defamatory, or infringing content
  • Attempt to gain unauthorized access to systems or accounts
  • Interfere with platform functionality or security
  • Reverse engineer or copy the platform except as permitted by law
  • Use automated scraping or data extraction tools without authorization
  • Misrepresent your identity or affiliation
  • Use the Services to harass or harm others

7. AI Features

Behavior Genie may incorporate artificial intelligence and machine learning features.

AI-generated outputs may:

  • Be incomplete or inaccurate
  • Not apply to your specific circumstances
  • Require human review and judgment
  • Change over time as models improve

You are solely responsible for evaluating and determining whether AI-generated suggestions are appropriate for your situation.

Behavior Genie makes no guarantees regarding the accuracy, reliability, or effectiveness of AI-generated content.

8. Subscriptions, Billing, and Free Trials

Certain features may require a paid subscription.

A. Free Trials

We may offer free trial periods for certain subscriptions or features. Unless otherwise disclosed at the time of signup, free trials will automatically convert to a paid subscription at the end of the trial period unless canceled before the trial ends.

B. Billing Authorization

By subscribing to the Services, you authorize Behavior Genie and its third-party payment processors to charge your selected payment method for applicable subscription fees, taxes, and recurring charges.

C. Subscription Renewals

Subscriptions may automatically renew on a recurring basis unless canceled before the applicable renewal date.

D. Cancellation

You may cancel your subscription at any time through your account settings or applicable app store platform. Cancellation will generally apply to future billing cycles and does not automatically provide refunds for prior charges.

E. Refunds and Billing Policy

Unless otherwise required by law, subscription fees are non-refundable once charged.

We understand that situations may arise and may review refund requests on a case-by-case basis at our discretion. If you believe you were charged in error, please contact us promptly at staff@behaviorgenie.com.

F. Price Changes

We reserve the right to modify subscription pricing, features, or plans upon reasonable notice. Continued use of the Services after pricing changes become effective constitutes acceptance of the updated pricing.

9. Intellectual Property

The Services, including software, branding, graphics, designs, text, interfaces, logos, and functionality, are owned by or licensed to Behavior Genie and protected by intellectual property laws.

Behavior Genie and related branding elements are proprietary to us.

Except as expressly permitted, you may not:

  • Copy or reproduce the Services
  • Modify or create derivative works
  • Distribute or commercially exploit platform content
  • Use our trademarks without permission

10. Feedback

If you provide suggestions, ideas, feedback, or recommendations, you grant us the right to use them without restriction or compensation.

11. Third-Party Services

The Services may integrate with or link to third-party providers, including payment processors, analytics providers, hosting providers, AI providers, or external tools.

We are not responsible for third-party services, products, content, or policies.

Your use of third-party services is subject to their own terms and policies.

13. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEHAVIOR GENIE DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY
  • RELIABILITY
  • AVAILABILITY
  • UNINTERRUPTED OPERATION

We do not guarantee that:

  • The Services will meet your expectations
  • The Services will be uninterrupted or error-free
  • AI-generated content will be accurate or appropriate
  • Data loss or security breaches will never occur

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEHAVIOR GENIE AND ITS OWNERS, AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND PARTNERS SHALL NOT BE LIABLE FOR:

  • INDIRECT DAMAGES
  • INCIDENTAL DAMAGES
  • CONSEQUENTIAL DAMAGES
  • SPECIAL DAMAGES
  • EXEMPLARY DAMAGES
  • LOSS OF DATA
  • LOSS OF PROFITS
  • BUSINESS INTERRUPTION
  • PERSONAL DECISIONS MADE BASED ON PLATFORM CONTENT OR AI OUTPUTS

OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SERVICES SHALL NOT EXCEED THE GREATER OF:

  • THE AMOUNT YOU PAID TO US IN THE PRIOR TWELVE (12) MONTHS; OR
  • ONE HUNDRED U.S. DOLLARS ($100)

Some jurisdictions do not allow certain limitations, so portions of this section may not apply.

15. Indemnification

You agree to indemnify and hold harmless Behavior Genie and its affiliates, officers, owners, employees, contractors, licensors, and partners from claims, damages, liabilities, costs, and expenses arising from:

  • Your use of the Services
  • Your User Content
  • Your violation of these Terms
  • Your violation of applicable law or third-party rights

16. Termination

We may suspend or terminate access to the Services at any time if:

  • You violate these Terms
  • We believe your conduct creates risk or harm
  • Required by law
  • We discontinue the Services

You may stop using the Services at any time.

Sections intended to survive termination shall remain in effect.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.

18. Dispute Resolution

Any dispute arising from these Terms or the Services shall be resolved exclusively in the state or federal courts located in Florida, and you consent to the jurisdiction and venue of those courts.

19. Changes to These Terms

We may update these Terms from time to time.

If we make material changes, we may provide notice through the Services or by updating the “Last Updated” date above.

Your continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms.
